General Terms and Conditions
1. General Information
Products’ sale offered through our website www.museoferragamo.com (hereinafter the "Website"), covered by the trademarks "Salvatore Ferragamo" and "Ferragamo", is governed by these general conditions of sale (the "Terms").
The products offered in the website are directly sold by Salvatore Ferragamo Italia S.p.A (hereinafter “Ferragamo”).
Ferragamo is an Italian company incorporated under Italian law, part of Ferragamo Finanziaria Group and subject to management and coordination of Ferragamo Finanziaria SpA as per Article 2497 bis Civil Code, with registered office in de 'Tornabuoni St. n. 2, 50123 Florence - Italy, tax code and VAT number 02175200480 REA number 02175200480.
2. Trade Policy
Products’ sale is only intended for individuals who are end-user consumers (hereinafter "Customers"). Customers include the individual who acts for purposes not related to trade, business or professional activity.
Following the above, Ferragamo reserves the right not to accept orders from other than the Customer.
At any time Ferragamo may modify or amend these General Conditions. In any case, the Customer will be required to accept only the General Conditions in force at the time of each order closing.
Each Order may include one or more products for a maximum of 3 pieces per each style, variation and colour.
For any purchase request higher than the maximum of 3 pieces, please contact MuseoCustomerCare@ferragamo.com. Ferragamo reserves the right to evaluate and approve such request and give an answer to the Customer in the shortest possible time.
Purchase orders for an amount of less than € 30,00 (thirty/00) will not be accepted.
Products sold through the website can be purchased and delivered exclusively to the countries where the service is available as displayed in the page of authentication to the site.
No order will be accepted if addressed to a PO Box or in case it is not possible to identify the individual receiving the Order as well as his private address.
Any notice to the Customer via e-mail will be addressed to the email provided by the Customer in the registration form.
3. Purchase conditions
The products offered for sale are available in the section “Shop” of the website. In such section, the Customer will be able to see photos of the products, to get information regarding price and delivery costs; VAT or sales tax (where expected) and possible import costs will be added. Such costs will be estimated and communicated to the Customer in the purchase process.
Images and colours of products offered, in some cases may be different because of the technical characteristics and resolution of equipment and software provided with the computer used by the Customer. The images and colours, then, must be considered as indicative, but asks the customers to verify the adherence of the product to their expectations. Ferragamo will not be responsible for any inappropriate images or colours of products due to these technical reasons.
To perform any orders for the products selected, the Customer will have to follow the instructions and procedures available on the Website.
The Client is kindly asked to verify the accuracy of the contents of each order before confirmation, filling in the purchase form according to the instructions provided on the corresponding page of the Website. Together with the completion of each Order, Customer will be asked to confirm to have carefully read and accepted the Terms. In case of non-acceptance of the Terms, the order will not be completed.
If the Customer wants to make changes or corrections to the order, this has to be done before order confirmation. Confirmed Order cannot be further modified or cancelled, except as expressly provided by the Terms or otherwise in the cases provided by Italian law.
At the end of the purchase process we strongly recommend to download, save or print the Order and the Terms prevailing at the time of submission. Customer will also receive an email confirmation of received order, containing a summary of information already contained in the order form i.e. Terms, information on the essential features of each product purchased, as well as details of price and delivery rate.
Any further subsequent change will be communicated to the Customer by e-mail.
The Customer will be able to check at any time the Order status by entering the website client restricted area, or by sending an email to the Customer Service at MuseoCustomerCare@ferragamo.com.
Each confirmed order will be automatically sent to the Salvatore Ferragamo SpA, Italy and after its execution will be stored at its operational office, located in Mercalli St, 201, 50019, Osmannoro, Sesto Fiorentino (FI).
4. Availability and Delivery
Customer acknowledges that stocks of products supplied by the Website are limited.
Occasionally, it may happen that a product is temporarily unavailable. In this case Ferragamo will inform the Customer as soon as possible, and in any case within 15 days from the Order’s arrival.
In this case Customer can choose between:
• Order cancellation (complete or partial)
• Substitution of the product originally requested
•
No charge will be made for the cancelled Order, in case the charge has already taken place, the refund will be performed as soon as possible.
Customer Service shall be contacted in order to get the necessary support.
Ferragamo will spare no effort to fulfil each order within 10 working days, and anyway within 30 working days from the day following the Customer’s Order.
At the moment the parcel with the ordered items will leave the warehouse, Ferragamo will send an e-mail to the address indicated by the Customer in the order form. This email will include a tracking code and a link that allows the monitoring of the delivery in real time.
The Customer Service is available to provide assistance for any matter relating to the delivery (MuseoCustomerCare@ferragamo.com).
5. Prices and payment
Products’ prices offered on the Website are expressed in Euro and are VAT inclusive for shipments to European Union countries.
For shipments outside the European Union the price of the products does not include VAT or sales taxes.
For Customers not resident in European Union countries, an estimate of the import costs to be sustained, as well as of approximate local taxes charges will be displayed before final confirmation of the order. Such costs will be beared by the Customer himself and paid upon receipt of the merchandise, directly to the courier.
The total amount of each order will also contain the shipping costs.
Ferragamo reserves the right to change prices of products offered and shipping at any time and without notice. Customer will be applied the prices published on the Website at the time of confirmation of each order.
Payment can be made only by credit card. Credit card accepted are: VISA and MASTERCARD.
Credit card payment transactions will be governed by specific credit card provider’s.
The shipment of the order will take place only after verification of Customer’s credit card data and after the authorization to carry out the charge on that credit card.
In case of order’s total or partial cancellation, for “plafond” prior commitments, will be worth the contractual terms of the Credit Card operator.
6. Shipment rates
Shipment cost will be calculated and displayed, along with other costs related to the purchase, at the end of the order form filling and prior to confirmation.
7. Non-Compliance Complaints
Customer shall check the goods immediately upon delivery, to determine compliance with the Order.
Any defect (i.e. tampering packaging or products damages, missing items or items different to those ordered and/or indicated in the shipment document) will be specifically described in writing directly on the delivery document to be signed by the Customer.
In case the items delivered do not correspond to the ordered ones or in case they arrive damaged, a Customer can initiate the return procedure, according to rules defined in the previous paragraph, by sending the form (available for download from the site) with all its parts properly filled in to the Customer Service by e-mail to MuseoCustomerCare@ferragamo.com or by fax to the number +39 055 3360770.
The return for “damaged product” will be accepted by Ferragamo only within previous check of the effective existence of the damage or defect.
Customer Service will enable the return procedure by releasing a special code to be filled in to the Return Form. Such form has to be sent back together with the product.
The Customer has the right to:
• Require the Order compliance by substituting the product with an identical item, if available.
• Cancel the Order and apply for refund. Such refund will be performed as soon as possible, and in any case according to the regulations adopted by the Credit Card operators.
In any case, shipment costs incurred in sending back the product to Ferragamo and delivery of the replacement product to the Customer will be supported by Ferragamo.
Customer must carefully follow the return procedure and once obtained the approval of the Customer Service, commit to UPS courier for shipping back the product.
8. Cancellation right
The Customer has the right to cancel the confirmed order, with neither penalty nor specifying the reason, within 10 working days from the day of Products’ receiving if resident in a country part of the European Union, and of 20 working days from the day of Products’ receiving if resident in a different country.
If products are delivered at different times, the period of 10/20 days will start on each product delivered from the time of its delivery.
The Customer may wholly or partially terminate the Order. All the expenses to send back the products (included possible import costs) are at the Customer’s expense.
Customer must return products to Ferragamo through the carrier for the shipment not later than the strict deadline of 10/20 working days from the date he received them.
To exercise the cancellation right, the Customer must send the form (available for download from the site) with all its parts properly filled in to the Customer Service by e-mail to MuseoCustomerCare@ferragamo.com or by fax to the number +39 055 3360770.
Customer Service will enable the return procedure by releasing a special code to be filled in to the Return Form. Such form has to be sent back together with the product.
Ferragamo advises customers to contact and commit to UPS for the shipment of the products. In such case, the delivery costs will be pre-paid by Ferragamo.
The delivery costs pre-paid by Ferragamo (included any import costs charged for the re-enter of the products) will be deducted from the amount to refund to the Customer for the product/s returned.
Cancellation right, in addition to the terms and conditions set out, can be exercised under the following conditions:
a) the return form must be correctly filled in and submitted via e-mail or fax;
b) products must be returned in the original packaging and conditions;
c) tags have to be still tied to items (if applicable).
Ferragamo will verify that the merchandise returned is actually in the original status.
If the cancellation right is exercised as mentioned before and products are in their original conditions, Ferragamo will refund the Customer with sum already paid by credit card as soon as possible and anyway within 30 days starting from the time the Customer exercised the cancellation right. The sums shall be deemed repaid when actually credited with currency not later than the above mentioned deadline.
Ferragamo does not allow to request on the Site the replacement or refund for goods purchased in physical stores Ferragamo or other boutiques, as well as no replacement or refund will be given in Ferragamo physical stores or boutiques, for products purchased on the Site.
9. Flawed Product Liability
Ferragamo will be liable for every Website product’s defect, included non compliance of products offered by the Website and ordered, according to Italian Legislative Decree n. 206 dated September 6th 2005 (Consumer Code).
The liability will arise if the defect come out within two years from the delivery of the product.
The Customer will lose rights specified below, if fails to report defect to Ferragamo within two months from the recognition thereof.
According to Article 130 of the Consumer Code, in case of defects, Customer is entitled to obtain correction of good free of charge, by fix or replacement, as well as a fair price rebate or cancellation of the contract on claimed products.
Returning costs for defect products or for products’ non compliance to the order, will be incurred by Ferragamo.
10. Applicable law and disputes
Terms are ruled by Italian law and will be interpreted according to it, with exception of any different prevailing mandatory law from the country of regular residence of the Customer.
In the event of any kind dispute, following applicable law, will have jurisdiction the Court of the place of Customer’s domicile or residence, as well as, upon Customer’s choice, the Court of Florence.
